Résumé de l’enjeu	L'infraction 391.11(b)(5) dans SafeSpect comporte entre parenthèses la mention « (non- CDL) », ce qui, selon nous, est une formulation incorrecte et devrait être supprimé (voir la capture d'écran n° 1). Il s'agit des qualifications requises pour un conducteur titulaire d'un permis CDL, et non pour un conducteur ne possédant pas de permis CDL, ce qui peut induire en erreur un transporteur. ASPEN n'a pas inclus cette mention dans l'infraction (voir la capture d'écran n° 2).
Justification ou besoin	Nous avons soumis une demande à la FMCSA/SafeSpect pour supprimer la mention « (NON- CDL) » et ils nous ont plutôt dit d'utiliser la partie 383 – l'Alaska n'ayant pas adopté la partie 383, nous ne pouvons pas citer cette section.
Demande d’action	Supprimez le texte « (non- CDL) » de 391.11(b)(5) dans SafeSpect.
Mesures prises par le comité	The Driver-Traffic Enforcement Committee discussed that at least five states have not adopted Part 383 and instead use 391.11(b)(5) as the violation for no valid CDL. The current violation description language in SafeSpect for 391.11(b)(5) states “non-CDL” which causes confusion for motor carriers. The committee agreed to submit the change request to the Information Systems Committee to remove the non-CDL language. For inspections conducted in states that have adopted Part 383, the inspectors will continue to cite 383.23 as noted in the OOSC. This issue will be reassigned to Information Systems for action. The non-CDL was removed from verbiage and has been implemented in SafeSpect.
