| Justification ou besoin | La formulation actuelle laisse croire aux inspecteurs qu'il existe deux cas de non-conformité pour un transporteur de biens : l'absence d'un certificat médical lié à sa licence et les antécédents d'infraction. Or, cette formulation est erronée. La modification proposée élimine toute possibilité d'erreur : il ne s'agirait plus d'un seul cas de non-conformité, et le transporteur devrait impérativement avoir à la fois un certificat médical et des antécédents d'infraction. |

| Mesures prises par le comité | Current verbiage leads inspectors to believe there are two possibilities for OOS for a property carrier if they have no medical tied to their license as well as if they have a history of violation of this matter. This is not correct and by modifying verbiage to the proposed wording, there leaves no room for misinterpreting that it is only one possibility for OOS and the property carrier must have no medical on file AND history of violation. During code writing we found incorrect verbiage, so we are requesting correction. Propose correcting language. Motion to amend OOS criteria Part 1- 4 (b)(4) “Operating a property-carrying vehicle without a valid medical certificate in possession or on file with the state driver’s’ license agency. If the driver fails to produce a medical certificate or has an expired medical certificate and has a previous history of either failing to produce a medical certificate or having an expired medical certificate. (391.41(a)) Declare the driver out of service. |
