Résumé de l’enjeu

Sur un châssis-cabine équipé d'une caisse fixée au châssis par des boulons en U à l'arrière, si six boulons en U maintiennent la caisse et que ces boulons se desserrent, à quel moment la mise hors service du véhicule serait-elle justifiée ? Par ailleurs, quel article du code serait applicable pour constater l’infraction et justifier la mise hors service ?

Justification ou besoin

Les boulons en U fixent l'ensemble du coffre au châssis du véhicule. S'ils se desserrent, le coffre peut bouger et potentiellement causer un accident ou d'autres pannes mécaniques. Il n’existe aucun article de code ou critère de non-conformité clairement défini applicable à ce cas précis.

Je cherche à déterminer si ce problème nécessiterait un ajout aux critères OOS.

Mesures prises par le comité

A previous issue 07-007-VEH was discussed, which addressed the same issue and how the Vehicle Committee came to a consensus that the current language in the out of service criteria for cargo securement sufficiently addresses this concern and that no change was necessary.

There was further discussion in the committee during the current meeting and a question was asked if we could use a set number loose (ie 25% or 50%), to determine OOS? Comments made that it may be a violation of 393.203 but how could we determine a number loose that places it OOS. Comment that it should be OOS if body has moved on frame but stay away from trying to tie a number percentage to it. Nobody in the committee has seen a shifted box and there is no data to support that a few loose u-bolts are an imminent hazard. A member asked that if there is 8 u-bolts and all 8 are loose, why would we let that go down the road. It was discussed that if the box has shifted, it would be an imminent hazard of falling off. It was the consensus of the committee that leaving the OOSC as is, would be the best course of action and if the box is in danger of falling off the frame and creating an imminent hazard then a 392.9a OOS violation can be noted under the current OOSC. No motion was made, item was CLOSED with no action taken.
