| Résumé de l’enjeu | Nous transportons des matériaux de classe 7 sur un itinéraire contrôlé par HW à Porto Rico. Une inspection de niveau VI avant le départ est requise au point de départ. Mes questions sont les suivantes : a) Si le point de départ est sur le territoire continental des États-Unis, est-il nécessaire de faire l’inspection de niveau VI au port de Porto Rico ? b) S’il n’y a pas d’inspecteur certifié de niveau VI sur l’île, pouvons-nous faire appel à un ingénieur mécanicien professionnel, connaissant la réglementation DOT CFR 49, pour effectuer l’inspection ? |

Nous n'avons aucun avocat compétent en matière de réglementation CFR 49 sur l'île et devons nous défendre nous-mêmes. L'inspection a été effectuée avec un ingénieur professionnel agréé, notre agent de conformité ; il s'agit d'une mission annuelle. |

| Mesures prises par le comité | The Federal Motor Carrier Safety Administration (FMCSA) requires all motor carriers that transport a Highway Route Controlled Quantity (HRCQ) of Class 7 materials file for a Hazardous Materials Safety Permit (49 CFR 385.403). Further, FMCSA requires that prior to leaving its point of origin, all HRCQ Class 7 shipments must pass a Commercial Vehicle Safety Alliance (CVSA) Level VI point of origin inspection (49 CFR 385.415(b)(1)). In your issue request you asked two specific questions which I will address individually. Question 1: “If the origin was in the USA mainland is it necessary to run the Level VI inspection at the port in Puerto Rico?” CVSA Reply: Upon a successful completion of a Level VI point of origin inspection and a Level VI decal is affixed, that single shipment of HRCQ Class 7 can moved from its point of origin to its point of destination without another Level VI inspection being required enroute, if that single shipment does not experience an out of service violation during the trip or the tractor and trailer are separated during the trip. Jurisdictions are not prohibited from conducting an enroute Level VI inspection or even a Level II or Level III of that shipment enroute to its destination. Question 2: “If there is non-certified inspector for Level VI in the Island, can we use a Professional Mechanical Engineer, knowledgeable, of the DOT CFR 49, to conduct the inspection?” CVSA Reply: The answer to your second question is no. CVSA Operational Policies specify only a certified Level VI Inspector can conduct a Level VI inspection and apply a Level VI decal. |
