Código eliminado de Safespect.

Justificación o necesidad

El código 376.11D1 se ha eliminado del programa Safespect. ¿Cómo registramos la infracción? Hemos tenido varias empresas que llevan una carpeta llena de diferentes números USDOT e identificaciones de empresas. Cuando detenemos una que ha sido declarada fuera de servicio por la FMCSA, simplemente toman otra empresa de la carpeta y la pegan al vehículo, generalmente durante el proceso de inspección. Luego, nunca tienen el contrato de arrendamiento requerido. No están sujetos a las regulaciones de camiones de alquiler 390.21, pero están cometiendo una clara infracción. Sin tener que llevar estos contratos de arrendamiento, pueden afirmar que trabajan para cualquier empresa y no podemos probar lo contrario. Gracias.

Medidas adoptadas por el comité

The committee recognizes the value of collecting data regarding carrier lease agreements for the purpose of conducting investigations and helping to establish reincarnated/chameleon carriers. There was concern raised by states that have not adopted Part 376 that the presence of this violation would negatively impact data quality. The committee discussed that training and accountability should be used to address data quality issues. The committee decided that adding § 376.11(d)(1) back to the violation code tables would provide a useful tool to states that can cite this violation when discovered. This was discussed at the board and the board thought it should be discussed in the Driver-Traffic Enforcement Committee. The issue was moved to be discussed there.

Driver-Traffic Committee discussed the issue. It was explained that some states have not adopted Part 376, which could cause potential confusion. Only five states at the voting table stated they have adopted Part 376. It was asked whether anyone was having issues enforcing Part 376, specifically regarding this issue request. It was discussed that this could be a good tool for roadside inspection, but the regulation, as written, could validate roadside enforcement. It was referenced that Part 376 is not taught during Part A training. No further discussion ensued and the issue was closed.
