| Resumen del asunto | Si se descubre un registro falso en más de un día en un ELD o RODS, ¿deben citarse infracciones separadas para cada infracción o, una vez que se considera falso un registro, solo debe haber una infracción falsa en el RODS? Anteriormente, teníamos la política de que si un registro era falso, todo el libro era falso. Dada la guía de Guard y el uso generalizado de RODS electrónicos, no estoy de acuerdo con esa política. Creo que una infracción de registro falso debe documentarse para cada período de 24 horas si se descubre, y si se trata de un intento de ocultar una infracción de HOS, debe considerarse fuera de servicio (OOS). | Medidas adoptadas por el comité | Issue request #20-033 DRV was previously tabled to clarify Operational Policy 14 regarding documenting HOS violations consistently throughout North America. Operational Policy 14 was reviewed, and the title “Form and Manner” had no items that related to form and manner below it. The committee decided to remove the language to clarify that all items listed in the Hours-of-Service section should be documented one time per 24-hour period. This was modified to correct Issue Request #20-033 DRV relating to properly documenting false records of duty status. While reviewing the Operational Policy, it was determined the co-driver language was redundant after the addition of co-driver information in the Part I Policy Statement. Form and Manner (DELETED TITLE ONLY): HOS violations should have specific detailed information regarding an HOS violation as defined in the pick-list (as defined in the Roadside Inspection Documentation Comparison Matrix). In addition to the default language, the inspector shall provide additional information detailing the specific violation. ........................................ (This paragraph in Operational Policy 14 will apply to False RODS as well) The HOS violations should be documented for the 24-hour period indicated on the record of duty status. Each 24-hour period should be treated separately. If the violation begins on one 24-hour period day and continues into the second day, it would be recorded as two violations. Multiple instances of the same violation during the same 24-hour period shall be recorded as one violation. Proper documentation shall include the date and time of each occurrence. ..................................................................
