| Justificación o necesidad | La Política Operativa 15 establece que las correas elásticas no pueden utilizarse como método principal de sujeción para asegurar artículos de carga y equipos de vehículos. Necesitamos revisar la Política Operativa 15 para excluir las lonas que cubren cargas y así aclarar la política para los inspectores de carretera. Además, necesitamos identificar qué infracciones relacionadas con las correas elásticas, si las hay, constituirán una infracción del CFR o una infracción de OOS. | Medidas adoptadas por el comité | The committee determined that there is no limit to the damage of a tarp strap to determine when it is defective. However, the issue turned to the discussion of Operational Policy 15 and the wording. It was determined that Canada and the US do not interpret the Ops Policy the same way. The definition of cargo is not the same in both countries and there is an outstanding enforcement letter from FMCSA that indicates that lightweight items that are not cargo can be secured with bungee cords and tarp straps. The Cargo Securement Forum and the Vehicle Committee agreed that the only resolve would be to rewrite the policy and clarify the allowances for bungee cords and tarp straps based on the rules of the country. The committee voted and agreed to the following: Regulatory Guidance b.(1) Can a bungee cord or tarp strap be used as a primary means of securing an article of cargo and does it need to be rated and marked with a working load limit (WLL)? Canada ANSWER: Bungee cords and tarp straps are not suitable for use as tiedowns securement devices, and are equally unsuited to having an assigned WLL. There is no intention to prohibit the use of these devices as supplementary restraint for lightweight cargo and equipment. EXCEPTION: Tarp Straps can be used as a primary securement for tarps to cover loads. United States ANSWER: Bungee cords and tarp straps are not suitable for use as securement devices and are equally unsuited to having an assigned WLL. There is no intention to prohibit the use of these devices as primary or supplemental restraint for articles such as tools and supplies that are not being transported as part of the shipment but are capable of falling from the vehicle if they are not secured. This would include items such as plastic bottles of automotive fluids (e.g. motor oil, windshield washer fluid, water, etc.) used for the operation of the vehicle, tire irons, tools and any other item that may fall from the vehicle. EXCEPTION: Tarp Straps can be used as a primary securement for tarps to cover loads. |
