FMCSR 393.70 ACOPLAMIENTO DE QUINTA RUEDA Se requiere una aclaración sobre la norma 393.70. Hemos observado que algunos transportistas (principalmente de áridos) en el área del condado de Harris operan tractocamiones con quintas ruedas inferiores pivotantes. El remolque del transportista también suele estar equipado con una quinta rueda pivotante. Con frecuencia, el transportista no cuenta con ningún dispositivo o tiene un dispositivo defectuoso para evitar que la quinta rueda inferior pivote, lo que provoca que el remolque se desplace bruscamente hacia atrás varios centímetros al acelerar o hacia adelante varios centímetros al desacelerar.

Justificación o necesidad

El impacto en los dispositivos de quinta rueda superior e inferior provoca una tensión excesiva en el pivote central, la cual, a mi parecer, no está diseñado para absorber. Dicha tensión se transfiere al resto de los conjuntos de quinta rueda superior e inferior. A menos que estos conjuntos ya estén dañados, no se registra ninguna infracción por este evidente problema de seguridad. Los pivotes centrales no son una parte del equipo de fácil inspección, ya que es necesario desacoplar el remolque para realizar una inspección adecuada.

Solicitud de acción

Incluir en la sección 393.70 una disposición que prohíba acoplar una quinta rueda inferior pivotante a una quinta rueda superior pivotante. Agregar una disposición que permita el uso de una quinta rueda inferior pivotante con un acoplamiento de quinta rueda superior pivotante si se utiliza un dispositivo que impida que el acoplamiento de la quinta rueda inferior pivote hacia adelante y hacia atrás con el eje longitudinal del tractor o camión.

Medidas adoptadas por el comité

The issue requested a modification to CFR Part 393.70 to disallow the coupling of a pivoting upper fifth wheel to a pivoting lower fifth wheel unless a device was used to prevent the lower fifth wheel from pivoting forward or rearward with the longitudinal axis of the vehicle. Allowing both fifth wheels to pivot could cause excess stress on the kingpin and transfer these stresses to the rest of the upper and lower fifth wheel assemblies. Information was submitted with the request explaining the importance of blocking the fifth wheel on these vehicle combinations as well as different ways of blocking the fifth wheel.

Discussion took place that CFR 393.70 does not address pivoting upper and lower fifth wheels being coupled together which means that it would be a violation that would need to be recorded under 396.3(a)(1). If the violation is recorded under 396.3(a)(1), it would need to be an imminent hazard situation to be included in the OOSC. The next step would then be to include it in a petition to FMCSA to fall in line with the current petition to include all violations recorded under 396.3(a)(1) be added to the CFRs. The issue that arises is that it must be an imminent hazard and committee members did not feel the situation rose to that level. Although the situation is not recommended and may cause additional stress to the coupling components, this stress would lead to violations that are already part of the CFR’s and the OOSC. No further action will be taken.
