| Resumen del asunto | La acumulación de nieve y hielo sigue siendo un problema en todo Canadá y gran parte de Estados Unidos. Se han producido innumerables colisiones con vehículos comerciales a causa del hielo desprendido. Algunos colegas canadienses me han pedido que incluya este tema en la agenda del Foro Público Norteamericano sobre Armonización de la sujeción de carga para determinar si la nieve puede o debe considerarse carga, con el fin de evitar que se desprenda y se convierta en un proyectil, o que dificulte la visibilidad. |

| Medidas adoptadas por el comité | A picture and several scenarios were discussed regarding snow and ice buildup on trailers and the severity of the situations that can occur when it becomes dislodged from the vehicle. It was discussed to determine if enforcement action can be taken under cargo securement to have the driver remove the snow and ice from the vehicle before continuing. Although everyone in the meeting agreed that in some instances this can cause serious situations, there is nothing under current regulation as it was determined that snow and ice is not considered cargo. There were other implications that were addressed to having drivers remove the snow. They cannot get up on the top of trailers due to rules regarding the height they would have to be at to adequately remove the snow. There are not adequate facilities at this time to provide means for the removal. Some attendees indicated that they have specific regulations in their province or state to deal with this but there is nothing that can deal with it in the Cargo Securement Regulations. Based on the fact that there is nothing in regulation, the Public Forum concluded it is not cargo, it is an “Act of God” and they closed the issue. |
