Resumen del asunto	Nevada cita la sección 393.13c1, "No se requiere lámina retrorreflectante lateral ni material reflectante para vehículos fabricados antes de diciembre de 1993 / cinta reflectante demasiado alta (>60") desde el suelo". Nuestros remolques están marcados como se reciben de fábrica y como es habitual en la industria de camiones cisterna. Montar dicho material reflectante a una altura igual o inferior a 60" lo haría ineficaz y no visible para los conductores que se aproximan.
Justificación o necesidad	Al aplicar esta normativa tal como está escrita, el uso de material reflectante en los laterales de la mayoría de los remolques cisterna se convertiría en un acto inútil, y la posibilidad, si no la realidad, de impactos laterales de remolques cisterna por parte de otros conductores que no puedan ver el material reflectante instalado exactamente según la normativa aumentaría drásticamente.
Solicitud de acción	Se debe revisar la normativa para evaluar su aplicación práctica en lo que respecta a los remolques cisterna. Los agentes deben recibir capacitación para hacer cumplir la normativa, aplicando al mismo tiempo el sentido común.
Medidas adoptadas por el comité	Discussion in committee was in reference to a NHTSA document that already existed allowing for tape to be higher than the required 60 inches where it is not practical to have it at that height. This has come up in the past,so the committee with the agreement from FMCSA felt that it would be best to include an guidance into Operational Policy 15 to address this issue. The following Question/Answer was developed and unamimously passed by the committee and subsequently by the Executive Committee to include the guidance as follows: Question: Retro-reflective sheeting is required to be applied to both sides of the trailer at a height of at least 380 mm (15 inches) and not more than 1525 mm (60 inches) above the road surface. In some cases, when this height is complied with on tank trailers, the sheeting will be canted downwards. Therefore, in some cases, the sheeting is applied higher than what is outlined in the regulations but is located “as close as practicable” to the required height and still allows for the tape to be mounted on a horizontal plane or as close to it as the shape of the trailer allows. In these cases, should a violation be documented? Answer: No, if a cargo tank does not have a frame or other suitable surface below the 1525 mm (60 inches) height to apply the sheeting in order for it to be on a horizontal plane, the sheeting may be located at a higher location, as close to the required height as practicable and no violation should be documented.

Al aplicar esta normativa tal como está escrita, el uso de material reflectante en los laterales de la mayoría de los remolques cisterna se convertiría en un acto inútil, y la posibilidad, si no la realidad, de impactos laterales de remolques cisterna por parte de otros conductores que no puedan ver el material reflectante instalado exactamente según la normativa aumentaría drásticamente.
