| Resumen del asunto | Entendemos que cuando un vehículo cumple con los criterios para ser dado de baja, se le debe colocar una etiqueta que lo indique. Esta política se menciona en la Política Operativa 5, pero sabemos que no siempre se cumple. Nuestra pregunta es si CVSA desea que se siga aplicando esta política. De no ser así, ¿debería revisarse la Política Operativa 5? 4. Formularios aplicables • El Informe de Inspección del Vehículo y del Conductor se utilizará para registrar los resultados de las inspecciones del conductor, el vehículo y la carga. Se elaborará incluso si no se detectan defectos y se entregará una copia al conductor, independientemente de si este acepta o no firmar el formulario. • Se debe colocar una pegatina de vehículo fuera de servicio en un vehículo que haya sido declarado fuera de servicio. • Las calcomanías de CVSA deben colocarse en un vehículo que pase la inspección, como se describe a continuación. |

| Medidas adoptadas por el comité | This issue was discussed during the meeting in Buffalo and it was determined that a survey should be sent out to all member jurisdictions to see if they use OOS decals or not. The current Operational Policy 5 and the NAS OOS Criteria Policy Statement currently indicates: “Authorized personnel shall declare “out of service” any motor vehicle which by reason of its mechanical condition or loading would be likely to cause an accident or breakdown. An “out-of-service” vehicle sticker shall be used to declare vehicles “out-of-service”.” The survey of jurisdictions indicated that 50% of the jurisdictions use OOS decals. The US Regulation 396.9(c)(1) requires that an OOS decal be issued, but there is no requirement in Canada. The OOS declaration is placed on the inspection report. Discussion around removing the policy from Operational Policy 5 was discussed, but industry in the room wanted the sticker to be used when jurisdictions have them and didn’t want more jurisdictions to stop using them. It was determined that the policy could be amended so that no jurisdiction, regardless of what they are doing will be going against CVSA policy. The committee passed the following amendment to Operational Policy 5. 4. Applicable Forms • A Driver-Vehicle Examination Report is to be used to report the results of driver, vehicle, and cargo examinations. It is to be prepared even though no defects are discovered and a copy given to the driver regardless of whether or not the driver consents to sign the form. • A vehicle out-of-service sticker shall be affixed to a vehicle that has been declared out-of-service as per jurisdictional regulations. • CVSA decals are to be affixed to a vehicle that passes inspection, as described below. |
