| Justificación o necesidad | Soy miembro del Comité de Revisión y Actualización de Capacitación (TRUC) del Centro Nacional de Capacitación de la FMCSA. Durante las clases de recertificación de instructores más recientes, realizadas en enero y febrero de 2013, se discutió qué abarca el término "Partes Ocultas" en la Política Operativa 5 de la CVSA. Este punto parece estar sujeto a diversas interpretaciones en cuanto a su alcance. Algunos opinan que: 1. se limita a elementos del fabricante, como cubiertas antipolvo y protectores de mangueras; 2. otros consideran que incluye elementos de posventa añadidos por el conductor o transportista; 3. muchos creen que abarca la imposibilidad de acceder a ciertos ejes del vehículo debido al diseño del fabricante (efectos de suelo o miembros bajos del bastidor) o incluso a la condición física del inspector. Muchos utilizan estas razones, en particular la número 3, para no medir todos los frenos que están en contacto con la carretera al momento de la inspección. Si no se emite una calcomanía CVSA cuando no se miden todos los frenos, el inspector no otorgaría crédito por una inspección periódica, e incluso si se proporciona una copia de la inspección, indicaría que no se midieron todos los frenos y, nuevamente, no se otorgaría crédito por una inspección periódica. | Medidas adoptadas por el comité | A joint session had been held with the Training Committee and the issues and opinions were quite varied. As a number of possible options became evident, an ad-hoc committee was formed. Key concerns involved aerodynamic devices, wheel covers and the difficulty in accessing the brake components on certain axles on some vehicles. The ad-hoc committee concluded that aerodynamic devices and wheel covers are permissible and in cases where these are present, the Level I inspection will still be conducted without having to remove these devices. The ad-hoc group reported to the committee that the item of greatest concern involves axles (particularly drive axles) that restrict accessibility for inspecting brakes and particularly pushrod stroke measurement. Rather than having inspectors decide for themselves, developing policy language will ensure a consist approach for when a vehicle qualifies for a Level I and when there are too many brakes inaccessible to qualify. When a brake is not accessible, “NM” (not measured) will be recorded on the inspection report. An inspection will qualify as a Level 1 only when up to 20% of the brake measurements are entered as “NM”. When more than 20% of the brake measurements are entered as “NM” it does not qualify as a Level I inspection. The 20% value is supported by FMCSA data on the degradation of stopping abilities. It was also agreed that brakes recorded as “NM” are to be considered compliant and all of the brakes on the vehicle are still used to calculate the 20% brake OOS condition. (i.e.: in the case of a vehicle with 10 brakes with 2 recorded as “NM”, two other defective brakes need to be present to reach 20%). Amendments to Operational Policy 5 were voted on as follows: Ops 5 – BRAKE MEASUREMENTS It shall be the policy of CVSA to record on inspection forms all brake measurements, if obtained during North American Standard Level I and Level V Inspections. If a brake measurement was not obtained due to a hidden component, then “NM” shall be documented for that wheel-end brake as well as being noted on the inspection report that it was not measured due to a hidden component. Brakes not measured will be considered compliant and still included in the 20% calculation. NOTE: The marking and measuring of pushrod travel is not required if a performance based brake test (PBBT) has been completed. Ops 5 – Level I North American Standard Inspection – An inspection that includes examination of driver’s license; medical examiner’s certificate and Skill Performance Evaluation (SPE) Certificate (if applicable); alcohol and drugs; driver’s record of duty status as required; hours of service; seat belt; vehicle inspection report(s) (if applicable); brake systems; coupling devices; exhaust systems; frames; fuel systems; lighting devices (headlamps, tail lamps, stop lamps, turn signals and lamps/flags on projecting loads); securement of cargo; steering mechanisms; suspensions; tires; van and open-top trailer bodies; wheels, rims and hubs; windshield wipers; emergency exits and/or electrical cables and systems in engine and battery compartments (buses), and HM/DG requirements as applicable. HM/DG required inspection items will be inspected by certified HM/DG inspectors. Note: If more than 20% of pushrod travel, on exposed pushrods, cannot be measured, then the inspection would not be considered a Level I inspection and shall be identified as a Level II inspection. Note: A 5 axle combination with one axle not measured will still require two defective brakes to be placed out-of-service for 20%. Ops 5 – VEHICLE INSPECTIONS (Para 2) For the purpose of a CVSA decal issuance, if no violation is detected during a North American Standard Level I or Level V Inspection due to a hidden part, other than pushrod stroke measurements, of the listed Critical Vehicle Inspection Items, then a CVSA decal shall be applied. However, if more than 20% of pushrod travel, on exposed pushrods, cannot be measured, then a CVSA decal shall not be applied. An inspector can still apply a CVSA decal even though his/her jurisdiction does not allow for the inspection of gaseous fuel systems. OOSC Policy Statement (Para 4) For the purpose of a CVSA decal issuance, if no violation is detected during a North American Standard Level I or Level V Inspection due to a hidden part, other than pushrod stroke measurements, of the listed Critical Vehicle Inspection Items, then a CVSA decal shall be applied. However, if more than 20% of pushrod travel, on exposed pushrods, cannot be measured, then a CVSA decal shall not be applied.
