Resumen del asunto

Las empresas de transporte tienen dificultades para cumplir con los requisitos de sujeción de paquetes de madera de tres o más niveles. La norma 393.118 exige que se coloquen amarres sobre el nivel intermedio de estas cargas. Cuando los paquetes colocados uno al lado del otro tienen alturas diferentes, la correa resulta ineficaz para asegurar el paquete inferior y, de hecho, ejerce presión hacia arriba sobre el paquete superior. Estas correas pueden, en realidad, hacer que la carga sea menos segura que si no se usan o no se ajustan. Sin embargo, los agentes están emitiendo multas por cargas que no tienen las correas o que las dejan sueltas.

Justificación o necesidad

Una compañía de transporte sufrió dos inspecciones en las que se registraron infracciones que la situaron por encima del umbral de sujeción de carga en los informes mensuales de la CSA. Esto perjudica su imagen ante sus clientes y pone en riesgo su negocio.

Solicitud de acción

Emita la siguiente guía para determinar cuándo se requieren correas sobre la capa intermedia de bultos para cumplir con 393.118(d)(3)(iv)(b)(1) y (2). Se requieren amarres sobre los bultos de la capa intermedia cuando: • Los bultos adyacentes lateralmente en una capa intermedia tienen una altura superior similar que permite colocar una correa lateralmente a través de los bultos, y dicha correa se puede tensar sin que se ejerza ninguna fuerza ascendente sobre ningún bulto colocado encima de la correa. No se requieren amarres sobre los bultos de la capa intermedia cuando: • Los bultos adyacentes lateralmente en una capa intermedia tienen alturas superiores diferentes y tensar cualquier correa colocada sobre los bultos de la capa intermedia generaría una fuerza ascendente sobre un bulto colocado encima de la correa. • La parte superior del bulto más alto está a menos de 72 pulgadas de la superficie superior de la plataforma del vehículo.

Medidas adoptadas por el comité

The discussion raised the following points: •Using straps over the middle tier is one of four methods for securing a load of lumber consisting of three or more tiers of bundles.

•Using straps between bundles is difficult when the right and left side stacks are different heights.

•Building stacks of bundles to achieve the same heights on each side of a vehicle is difficult and time-consuming.

•Straps placed over middle tiers with uneven heights will exert upward force on bundles placed above the straps. Tightening the ‘belly’ straps before tightening the straps over the top of the load actually lifts the bundles placed on top of the ‘belly’ straps and even shifts the bundles sideways. Tightening the ‘belly’ straps after tightening the straps that go over the top of the load prevents the ‘belly’ straps from tightening properly and the ‘belly’ straps provide no downward force on their anchor side.

•Guidance provided for application of the Canadian regulations allows stacks of three or more tiers that have a top height less than 6 feet, to be secured with straps over the top of the load and no straps are required over middle layers.

•Enforcement officers are demanding the use of ‘belly’ straps despite the uneven tiers of bundles and issuing violations when the straps are missing.

It was reported that the forum had reached the consensus to recommend that the Vehicle Committee petition FMCSA to amend the regulation to adopt the same standard as NSC Standard 10 and the model regulation. The amendment would allow for stacks that are less than 6 feet to be secured without requiring belly straps. It was suggested that an interim guidance could be issued by FMCSA until the Regulation 393.118 is amended. The committee voted to petition FMCSA for an amendment to 393.118, with the following suggested wording:

Tiedowns are required over bundles in a middle tier when the top of the highest bundle in a stack is more than 72 inches from the top of the vehicle deck surface

Tiedowns are not required over bundles in the middle tier of a stack when the top of the highest bundle in a stack is 72 inches or less from the top of the vehicle deck surface.

This reflects the same requirements outlined in both the updated Model Regulation as well as NSC Standard 10.

This motion was passed by CVSA Executive Committee.

This issue will remain open pending the response from FMCSA on the petition.
