| Resumen del asunto | La Sección 393.128 (b)(1) de las FMCSR y la Norma 88(2) de la NSC 10 exigen lo siguiente: Un vehículo ligero debe estar sujeto tanto en la parte delantera como en la trasera para evitar que se mueva lateralmente, hacia adelante, hacia atrás y verticalmente utilizando un mínimo de 2 amarres. Con la experiencia, hemos comprobado que el uso de dos cadenas sin tensores en la parte trasera del vehículo y dos cadenas con tensores en la parte delantera garantiza una sujeción mucho mejor del vehículo que se transporta en la plataforma de una grúa. Utilizamos el cabrestante para aplicar tensión a las cadenas traseras y luego colocamos las cadenas con tensores en la parte delantera. Esta es la forma más rápida y segura para que el operador y el vehículo garanticen una sujeción adecuada. El problema es que algunas jurisdicciones exigen que las cadenas traseras incluyan dispositivos de tensión. Presumimos que el vehículo está sujeto tanto en la parte delantera como en la trasera y que estamos utilizando el requisito mínimo de 2 amarres. |

| Medidas adoptadas por el comité | It was reported to the Vehicle Committee that the Cargo Securement Public Forum has discussed this issue which sought approval for a method of securing a vehicle on a deck or platform using restraints (chains) at the rear of the deck, using the tow truck winch to draw the vehicle forward and then adding tiedowns to the front of the vehicle. The discussion raised the following points:• This type of transport falls into the regulations and the rules need to be followed. US and Canadian regulations require a tiedown to have a means to permit the driver to tighten it. Using a chain to restrain a vehicle at the rear offers no means for the driver to tighten the chain. It was further reported that the forum reached the consensus that the method described does not comply with the regulations. The chains used to restrain the rear do not qualify as tiedowns when there is no independent means of tightening them. The Regulators Group requested the forum to forward this issue to them for discussion to determine if there may be a need for a possible exemption in emergency situations. It was further reported at a subsequent meeting that this issue was left open pending any further guidance from the Regulators Group for exemptions in emergency situations.The Regulators Group reported that they would not be acting on the issue, they agreed with the points previous raised by the Forum attendees that it was not their place to attempt to address any emergency transport situations. There will be no further action regarding this issue by the forum and the issue is closed. |
