Résumé de l’enjeu	Ruban de signalisation visible - FMVSS 571.108 et FMCSR 393.11 L'article 393.11 et le document de l'ETA publié par la FMCSA confirment tous deux que seulement deux bandes de signalisation de 30,5 cm (12 pouces) de long, de chaque côté de la remorque, sont permises en haut à l'arrière. La NHTSA a publié une interprétation en 1994 stipulant clairement que deux bandes de 61 cm (24 pouces) de long, placées en haut à l'arrière de la remorque et épousant son contour, sont équivalentes à deux bandes de 30,5 cm (12 pouces) de long de chaque côté, en haut à l'arrière de la remorque.
Justification ou besoin	Les inspecteurs routiers doivent savoir qu'un morceau de ruban adhésif de visibilité de chaque côté, en haut de la remorque à l'arrière, est autorisé.
Demande d’action	Publier un bulletin d'inspection informant l'agence MCSAP responsable de chaque province de cette exigence. Demander à la FMCSA de mettre à jour les exigences de l'article 393.11 et du dossier ETA, qui stipulent clairement qu'un morceau de ruban adhésif de visibilité de 24 pouces de longueur de chaque côté, en haut de la remorque à l'arrière, est autorisé.
Mesures prises par le comité	The HM Committee voted to sent this action item over to vehicle as it deals with conspicuity tape requirements. It will be sent to Vehicle Committee for discussion at their next meeting. The Vehicle Committee reviewed the NHTSA Interpretation 9050 document that provides guidance indicating that this issue was examined and the use of one continuous 24” strip was deemed equivalent and amended Operational Policy 9.b.3 as follows: 9. LIGHTING SYSTEMS b.(3) Retro-reflective sheeting is required to be applied to both sides of the trailer at a height of at least 15 inches (380 mm) and not more than 60 inches (1,525 mm) above the road surface. In some cases, when this height is complied with on tank trailers, the sheeting will be canted downward. Therefore, in some cases, the sheeting is applied higher than what is outlined in the regulations but is located as close as practicable to the required height and still allows for the tape to be mounted on a horizontal plane or as close to it as the shape of the trailer allows. In other cases, there is rear upper retro-reflective sheeting consisting of one 24-inch strip, rather than two 12-inch strips, on the rounded body of the tank trailer. In these cases, should a violation be documented? ANSWER: No, if a cargo tank does not have a frame or other suitable surface below the 60 inches (1,525 mm) height to apply the sheeting in order for it to be on a horizontal plane, the sheeting may be located at a higher location, as close to the required height as practicable. Also, as per National Highway Traffic Safety Administration Interpretation 9050, on the rear of a tank trailer, a curved 24-inch strip applied to the rounded body of the tank is equivalent to two 12-inch strips. In both cases, no violation should be documented.
