| Mesures prises par le comité | Vehicle committee submitted a petition to FMCSA to amend the definition of semi-trailer so that safety chains will apply to all trailers that are not fifth wheels. The petition to change the definition of a semi-trailer was denied due to lack of supporting data. The members of the Vehicle Committee were vocal about how many instances there are regarding trailers detaching and safety chains failing. Currently, 393.70(d) only requires safety chains for full trailers. Based on the definitions contained in 393, the majority of ball hitch and pintle hook trailers are not full trailers and therefore, the requirement and condition of safety chains is not enforceable under federal regulations. It was explained the issue to some of the newer members of the committee to ensure that they understood the concern. Full trailers are defined as “any motor vehicle other than a pole trailer which is designed to be drawn by another motor vehicle and so constructed that no part of its weight, except for the towing device, rests upon the self-propelled towing motor vehicle. A semi-trailer equipped with an auxiliary front axle (converter dolly) shall be considered a full trailer.” The majority of trailers out there with safety chains are defined as semi-trailers “any motor vehicle, other than a pole trailer, which is designed to be drawn by another motor vehicle and I constructed so that some part of its weight rests upon the self-propelled towing motor vehicle”. It was further mentioned that the majority (between 45 and 50 states) have state law requiring safety chains on trailers that are defined as semi-trailers in the federal regulations. Due to the information received, the committee agreed that if the only way that FMCSA will address the issue is with more data, then there needs to be a violation code developed to specifically address the condition. It cannot currently be extracted from inspection data, because there is no violation. It was also asked by members of the committee to send in any collision data that they have in relation to trailer separation cause from lack of condition of safety chains on semi-trailers. The committee discussed creating a violation code under 392.2 (state law violations) so that FMCSA could collect the data they require. The committee unanimously agreed to approve a violation code of 392.2AFCH – no, inadequate, or defective safety chains. This suggestion was presented to the Information Systems Committee. They approved the request and presented it to Executive Committee. This issue will be closed until more data can be collected. |
