Investigators do not have access to SafeSpec inspections and attached documents created by other jurisdictions.

Justificación o necesidad

Investigators are currently unable to utilize SafeSpect to view and retrieve inspections and attached evidentiary documents generated by other states (i.e., ELD records, logbooks, bills of lading, CMV photographs, etc.). While this information is fully accessible for in-state inspections, it is not on a cross-state basis. Under the current FMCSA evidentiary mandates for Legal Sufficiency, obtaining roadside documents is often pivotal to establishing carrier control, proving commerce, verifying trip dates and/or confirming records of duty status. The cross-state inspection access restriction limits investigators' ability to identify and collect potential evidence. In previous cases during which we attempted to contact other states to learn what evidence might exist, we have experienced either long response delays due to scheduling and time zones differences or simply been unable to make contact at all.

Allowing cross-state SafeSpect access to inspections and associated attachments will speed workflow and, in many cases, provide the only evidence available to prove violations committed by bad actors. Investigators will be able to instantly identify existing evidence and determine next steps.
