| Resumen del asunto | A company transports new trailers such as travel, recreational, and utility trailers from the manufacturer to the dealers. Wyoming doesn’t recognize the Federal Title 23 exclusion for the tire bulge, fenders protruding =< 3” beyond the 102” wide body and road spray mitigation devices. They refuse to write a citation but also won’t allow them to proceed with moving these loads without buying permits. See FHWA regulatory citation under Title 23: § 658.16 Exclusions from length and width determinations. (a) Vehicle components not excluded by law or regulation shall be included in the measurement of the length and width of commercial motor vehicles. (b) The following shall be excluded from either the measured length or width of commercial motor vehicles, as applicable: (1) Rear view mirrors, turn signal lamps, handholds for cab entry/egress, splash and spray suppressant devices, load induced tire bulge. |
| Justificación o necesidad | Need for clarity for both industry and enforcement to ensure uniformity. |
| Solicitud de acción | Request for guidance from FHWA or FMCSA on whether the exclusion applies when the vehicle is a piece of cargo or when it’s on the ground. The regulation is silent on this situation. |
