La Parte II de la política OOSC debe modificarse para reflejar otros elementos de la Parte que no son condiciones mecánicas, como salidas de emergencia, cargas sobresalientes, etc.

Justificación o necesidad

La política actual de OOSC Parte II indica: FUERA DE SERVICIO: El personal autorizado deberá declarar fuera de servicio cualquier vehículo de autotransporte que, debido a su estado mecánico o carga, pudiera causar un accidente o avería. Esta política no contempla las condiciones de FUERA DE SERVICIO relacionadas con algunas de las condiciones de la Parte II del OOSC vigente.

Solicitud de acción

Modificar la política de OOSC para que refleje todos los aspectos de la Parte II, tras identificar la cantidad de elementos en dicha parte que no necesariamente causan un accidente o avería, pero que aumentan la gravedad del mismo.

Medidas adoptadas por el comité

The current OOSC Part II policy indicates: “OUT OF SERVICE: Authorized personnel shall declare out of service any commercial motor vehicle which by reason of its mechanical condition or loading would be likely to cause a crash or breakdown.” The current policy does not reflect OOS conditions related to some of the conditions in the current Part II of the OOSC. The discussion was in relation to things like emergency exits, missing fuel caps, exhaust leaks, etc. that do not directly cause a crash or breakdown but should be OOS due to the increased possibility of death or injury during a crash. The current policy does not allow for the existing items previously mentioned to be contained in Part II of the OOSC. Amending the policy to include severity of injury or death justifies the items discussed and allows the Vehicle Committee to contemplate the addition of other items that may come up in the future if they meet the requirements in the policy statement. The committee voted and the action item passed with a vote of 9 for, 8 against, and 2 abstentions to amend the language in the policy as follows:

OUT OF SERVICE: Authorized personnel shall declare out of service any commercial motor vehicle which by reason of its mechanical condition or loading would be likely to cause a crash, breakdown or significantly increase the severity of injury or death during a crash. An OOS vehicle sticker shall be used to declare vehicles out of service as per jurisdictional regulations. No motor carrier shall require nor shall any person operate nor any inspector release any commercial motor vehicle declared out of service until all repairs required by the OOS notice have been satisfactorily completed to where a violation no longer exists.

This wording failed the board of directors and the issue was left open to revisit during the board of directors meeting in June 2021. It was also discussed at the board, that the policy statements for each Part should be looked at for consistency and it may be necessary to amend some or all of the policy statements to align with the current OOSC. This issue will remain open to track the status of this issue.

The policy was reworded and approved to read as follows:

OUT OF SERVICE: Authorized personnel shall declare out of service any commercial motor vehicle that, by reason of its condition or cargo securement, presents an imminent hazard precluding safe operation of the commercial motor vehicle. An out-of-service vehicle sticker shall be applied to the applicable vehicle(s) when a vehicle is out of service as per jurisdictional regulations. No motor carrier shall require to be operated, nor shall any person operate, nor any inspector release the commercial motor vehicle declared out of service until all repairs required by the out-of-service notice have been repaired so that the violation(s) no longer exists.

“imminent hazard” means the existence of any condition of a vehicle or cargo that substantially increases the likelihood of serious injury if not discontinued immediately.
