Resumen del asunto	En varias inspecciones de Nivel I que involucran vehículos combinados, se está dando de fuera de servicio incorrectamente un vehículo cuando las mediciones de los frenos no cumplen con el criterio del 20 % (es decir, todos los frenos están desajustados en una unidad, pero el inspector da de baja ambas). No existen indicaciones claras en los North American Standard Out-of-Service Criteria (OOSC) que indiquen a los inspectores qué unidad(es) deben dar de fuera de servicio. Como instructor de NASI, sería útil contar con una nota que lo indique dentro del área del criterio del 20 % de baja.
Justificación o necesidad	En la próxima revisión de los North American Standard Out-of-Service Criteria (OOSC).
Solicitud de acción	Sugerencia: INSERTAR EN los North American Standard Out-of-Service Criteria (OOSC), Parte II, Punto 1.a., una "NOTA" que indique: "Para combinaciones de vehículos, solo se deben poner fuera de servicio las unidades que comprenden el criterio del 20% de frenos defectuosos".
Medidas adoptadas por el comité	This issue was handled in conjunction with 09-019-VEH. Discussion around these issues resulted in 3 issues that needed to be addressed to assist inspectors and industry on requirements when vehicles are placed out-of-service. 1 What needs to be repaired to return to service? 2 The prohibition against repairing an OOS condition by creating a violation? 3 That vehicles in a combination declared OOS that have none of the OOS conditions, can be returned to service immediately. This change also affects Operational Policy 5, Required Repairs for Out-Of-Service Notices and Inspection Guidance ? Frequently Asked Questions? #2 (approved in Louisville). This issue was also given to the Hazardous Materials Committee to develop a policy for Part III as well to deal with the same issue. Revised Wording: OUT-OF-SERVICE: Authorized personnel shall declare and mark "out-of-service" any motor vehicle which by reason of its mechanical condition or loading would be likely to cause an accident or breakdown. An "out-of-service vehicle" sticker shall be used to mark vehicles "out-of-service." No motor carrier shall require nor shall any person operate, or any inspector release any commercial motor vehicle declared and marked "out-of-service" until all repairs required by the "out-of-service notice" have been satisfactorily completed to where a violation no longer exists.When a vehicle is declared out-of-service for a condition resulting from an accumulation of violations, all violations that contributed to the specific out-of-service condition must be repaired (e.g. a vehicle, or vehicles in combination declared out-of-service for 20 percent defective brake violations must have all the 20 percent defective brake violations repaired prior to being released; or, a vehicle declared out-of-service for two tires at less than 1/32 inch (.8mm) tread depth must have both tire violations repaired prior to the vehicle being released, etc).An out-of-service condition cannot be corrected by creating a new violation (e.g. if a vehicle is declared out-of-service for three missing wheel fasteners on one wheel, wheel fasteners from other wheels cannot be removed to correct this out-of-service condition, etc).When vehicles in combination are declared out-of-service for 20 percent defective brake violations, any vehicle within the combination that does not contain a brake violation that contributed to the 20 percent defective brake out-of-service condition is allowed to proceed providing it does not contain any other out-of-service conditions.No person shall remove the "out-of-service vehicle" sticker from any motor vehicle prior to completion of all repairs required by the "out-of-service notice." Executive Committee approved the amendment.
