FMCSA Requests Comments on NSTA CDL Exemption Application
On June 30, the Federal Motor Carrier Safety Administration (FMCSA) requested comments on the National School Transportation Association (NSTA) request for an exemption from the engine compartment portion of the pre-trip vehicle inspection skills testing requirement, known as the “under-the hood” testing requirement, for commercial driver’s license (CDL) applicants seeking a school bus endorsement. Comments are due by July 30.
FMCSA Requests Comments on Lone Star HOS Exemption Application
On June 30, FMCSA requested comments on Lone Star Hazmat Response LLC’s (Lone Star) application for exemption to allow its field response drivers to exceed the hours-of-service (HOS) requirements for the purpose of returning to their normal work reporting location or residence following hazardous materials incident response operations. Comments are due by July 30.
FMCSA Requests Comments on Mainline HOS Exemption Application
On June 30, FMCSA requested comments on Mainline Services LLC’s (Mainline) application for an exemption from the HOS regulations to allow its employees who transport equipment used to clear derailed or disabled trains or debris blocking tracks or railroad rights-of-way when they are responding to unplanned events that affect interstate commerce, service, or the safety of railway operations, including passenger rail operations, and that occur outside of or extend beyond the employee’s normal shift. Comments are due by July 30.

FMCSA Removes 10 Devices from List of Registered ELDs
On July 9, FMCSA removed the following electronic logging devices (ELDs) from its list of registered ELDs and placed them on the revoked ELDs list due to the providers’ failure to meet the minimum requirements established in Title 49 CFR Part 395, Subpart B, Appendix A.

Motor carriers and drivers were instructed to discontinue using the revoked devices and revert to paper logs or other logging software to record required hours-of-service data. The revoked ELDs must be replaced with a compliant ELD from the registered ELDs list before Sept. 8. Motor carriers and drivers that use the revoked ELDs listed above on or after Sept. 8 will be in violation of § 395.8(a)(1) – No Record of Duty Status and will be placed out of service in accordance with CVSA’s North American Standard Out-of-Service Criteria.
