FMCSA Requests Comments on Clarification to the Applicability of Emergency Exemptions
On Jan. 9, the Federal Motor Carrier Safety Administration (FMCSA)  comments on its proposed revision, changing from 14 days to 30 days the length of the emergency relief automatically triggered subsequent to a regional declaration of emergency by a governor of a state, their authorized representative or FMCSA. This proposal responds to several petitions for reconsideration, including one , and would reverse one change made by a  published in October 2023. Comments are due by March 10.

FMCSA Publishes Transportation of Fuel for Agricultural Aircraft Operations Final Rule
On Jan. 9, FMCSA  the Transportation of Fuel for Agricultural Aircraft Operations final rule, which amends the Federal Motor Carrier Safety Regulations (FMCSR) to allow states to waive the hazardous materials endorsement requirement for holders of Class A commercial driver’s licenses (CDL) who transport no more than 1,000 gallons of aviation-grade jet fuel in support of seasonal agricultural aircraft operations. The final rule is effective March 10, and petitions for reconsideration are due by Feb. 9.

FMCSA Requests Comments on Study of Warning Devices for Stopped CMVs ICR
On Dec. 23, 2025, FMCSA  comments on the Study of Warning Devices for Stopped Commercial Motor Vehicles (CMV) information collection request (ICR), which is an experimental study that requires data collection for evaluating whether warning devices meaningfully influence crash-relevant aspects of human performance in the presence of a parked or disabled CMV, and if so, how and to what extent. Comments are due by Jan. 22.

Update on Exemptions

FMCSA Requests Comments on Aumovio SE Exemption Application
On Jan. 9, FMCSA  comments on an application for exemption submitted by Aumovio SE to allow motor carriers to operate CMVs equipped with Aumovio SE’s ProViu Mirror camera monitor system installed as an alternative to the two rear-vision mirrors required by the FMCSRs. Comments are due by Feb. 9.

FMCSA Grants Massachusetts CDL Skills Test Exemption
On Dec. 31, 2025, FMCSA  its decision to grant an exemption to the Massachusetts Department of State Police allowing the state to waive specific portions of the CDL skills test for CDL applicants who take the skills test on the island of Martha’s Vineyard and issue those drivers a restricted CDL. The exemption is effective from Dec. 31, 2025, through Dec. 31, 2027.

FMCSA Extends Waiver for Use of Paper Medical Examiner’s Certificate
On Dec. 30, 2025, FMCSA  a notice extending its waiver from certain regulations applicable to interstate CDL holders, commercial learner’s permit holders and motor carriers to allow them to continue to rely on a paper copy of the medical examiner’s certificate as proof of the driver’s medical certification for up to 60 days after the date the medical examiner’s certificate was issued. The waiver is effective from Jan. 11 through April 10.

FMCSA Removes Four Devices from List of Registered Electronic Logging Devices
On Dec. 30, 2025, FMCSA  the following electronic logging devices (ELD) from its list of registered ELDs and placed them on the revoked ELDs list due to the providers’ failure to meet the minimum requirements established in Title 49 Code of Federal Regulations Part 395, Subpart B, Appendix A.

  • P3TS by Top Tracking System LLC (ELD Identifier: TTSP3T)
  • Forward Thinking Systems – Field Warrior ELD (BYOD) by Forward Thinking Systems LLC (ELD Identifier: FTSFW1)
  • Forward Thinking Systems – Field Warrior ELD (Garmin) by Forward Thinking Systems LLC (ELD Identifier FTSFW2)
  • Dynamic ELD by Midwestern Logistics LLC (ELD Identifier DRS242)

Motor carriers and drivers were instructed to discontinue using the revoked devices listed above and revert to paper logs or other logging software to record required hours-of-service data. The revoked ELDs must be replaced with compliant ELDs from the registered ELDs list before March 1.

Motor carriers and drivers that use the revoked ELDs listed above on or after March 1, will be in violation of § 395.8(a)(1) – No Record of Duty Status and will be placed out of service in accordance with CVSA’s North American Standard Out-of-Service Criteria.
