FMCSA Requests Comments on Waiver and Exemption Requirements ICR
On April 16, the Federal Motor Carrier Safety Administration (FMCSA) requested comments on the Waiver and Exemption Requirements information collection request (ICR), which relates to the reporting tasks required for requesting waivers and exemptions. Comments are due by May 16.
FMCSA Requests Comments on Commercial Driver Licensing and Testing Standards ICR
On April 16, FMCSA requested comments on the Commercial Driver Licensing and Testing Standards ICR, which relates to compliance with notification and recordkeeping requirements for information related to testing, licensing, violations, convictions and disqualifications and ensuring the information is accurate, complete, transmitted and recorded within certain time periods as required by the Commercial Motor Vehicle Safety Act of 1986, as amended. Comments are due by May 16.
FMCSA Requests Comments on Driver Qualification Files ICR
On April 15, FMCSA requested comments on the Driver Qualification Files ICR, which relates to compliance with the reporting and recordkeeping tasks required for motor carriers to maintain driver qualification files. Comments are due by May 15.
Update on Exemptions
FMCSA Grants K & L Cargo Securement Exemption
On April 21, FMCSA announced the approval of an exemption request from K & L Trucking Inc. (K & L) to allow the company to secure large metal coils to its trailers using a cargo securement system that differs from that required by the Federal Motor Carrier Safety Regulations (FMCSR). This exemption is effective April 21, 2025, through April 21, 2030.
FMCSA Requests Comments on APA HOS Exemption
On April 18, FMCSA requested comments on the American Pyrotechnics Association’s (APA) application for exemptions from certain hours-of-service (HOS) regulations. The exemptions would allow drivers to exclude off-duty and sleeper berth time of any length from the calculation of the 14-hour limit and to use paper records of duty status in lieu of an electronic logging device during the designated period of June 28 through July 8. The requests are for the transportation of pyrotechnics during the Independence Day period of every year from 2025 through 2029. Comments are due by May 19.
FMCSA Requests Comments on Yarde Metals Amber Brake-Activated Pulsating Lamp Exemption
On April 17, FMCSA requested comments on an application from Yarde Metals Inc. (Yarde Metals) for an exemption from the requirement that all exterior lighting devices be steady burning. The exemption would allow Yarde Metals to use an amber brake-activated pulsating lamp on its commercial motor vehicles (CMV) in addition to the steady-burning brake lamps required by the FMCSRs. Comments are due by May 19.
FMCSA Grants Coffeyville Intellistop Module Exemption
On April 16, FMCSA announced its decision to grant an application from Coffeyville Resources Crude Transportation (Coffeyville) for an exemption to allow it to operate CMVs equipped with a module manufactured by Intellistop Inc. (Intellistop), which is designed to pulse the required rear clearance, identification and brake lamps from a lower-level lighting intensity to a higher-level lighting intensity four times in two seconds when the brakes are applied and then return the lights to a steady-burning state while the brakes remain engaged. This exemption is effective April 16, 2025, through April 16, 2030.
