PHMSA Grants Petition Related to Lithium Batteries
On April 29, PHMSA granted a petition related to lithium batteries in response to CVSA’s letter recommending a series of changes to how lithium batteries are regulated, as well as additional guidance for emergency responders.

CVSA Petitions FMCSA to Amend § 392.4
On April 10, CVSA petitioned FMCSA to amend § 392.4, Drugs and other substances, to include language that prohibits a driver who has been cited and issued an out-of-service order under § 392.4 from violating that out-of-service order.
CVSA Submits Comments to HM-265 NPRM
On April 9, CVSA submitted comments in response to PHMSA’s notice of proposed rulemaking (NPRM) seeking stakeholder feedback on proposed revisions to the Hazardous Materials Regulations intended to enhance the safe transportation of hazardous materials in commerce.
CVSA Petitions FMCSA to Amend § 393.87
On March 26, CVSA petitioned FMCSA to amend § 393.87, Warning flags on projecting loads, to require that CMVs with added items or equipment that extend beyond 4 feet from the rear of the vehicle must have the extremities of the added device or equipment marked with lamps and/or flags.
CVSA Sends Letter to FMCSA on OOS Rate for New Entrant Safety Audits
On March 19, CVSA sent a letter to FMCSA seeking clarification on the requirements for calculating the out-of-service (OOS) rate for New Entrant Safety Audits.
Petition to Remove the Rear Impact Guard Labeling Requirement
On March 11, CVSA resubmitted its petition FMCSA to amend § 393.86, Rear impact guards and rear end protection, by removing § 393.86(a)(6), Certification and labeling requirements for rear impact protection guards, from the Federal Motor Carrier Safety Regulations.
FMCSA Grants CVSA Petition for Reconsideration Regarding Emergency Exemption Final Rule
On Jan. 13, FMCSA granted CVSA’s petition for reconsideration regarding FMCSA’s final rule on the applicability of emergency exemptions.
